What is the FBI's deal with the local telecom operators in Romanai where it concerns tapping phones? Do you excercise this right on a regular basis, and if yes, how many phone taps has the FBI requested in Romania (on terrorism issues or online fraud issues). I am asking this sincerely since in Europe there is a huge distrust of American goverment institutions infringing the rights of its own citizens under the pretext of the "Patriot Act" , therefore worrying enormously about what the FBI does outside the US (with the cooperation of the country's local goverment). I assume we will get an evasive answer on this, but the US constitution (including the Patriot Act) are not inforcable in Romania, but I am worried that the FBI has already crossed that line in Romania. I have three questions related to file-sharing.
1. Does FBI's activity in Romania also concern observing peer-to-peer file-sharing networks? (BitTorrent, eDonkey, etc.). If so, how do you observe the network while guaranteeing the privacy of the peer-to-peer network users?
3. How do you align the US law concerning the upload and download of copyrighted material with the Romanian and European laws? In other words, will you try to prosecute Romanian users who download material copyrighted in US, which is illegal in US, but not in Romania and Europe?

3. In general, utilizatorii care descarca materiale de pe internet pentru folosul propriu nu sunt condamnate. Desi aceste infractiuni sunt importante, ele nu constitutie partea principala a activitatii mele.

In general, Romania are legi eficiente, problema este ritmul lent in care se desfasoara procesele, care se pot intinde pe ani. Probabil aceasta e o problema care ar trebui rezolvata prin elaborarea de legislatie de catre Parlament.

Nu cunosc informatii despre asemenea cazuri. Astfel de cazuri sunt posibile doar atunci cand sunt implicate persoane care beneficiaza de imunitate diplomatica. In aceste cazuri, se aplica tratatele internationale.
Ofiterii de legatura internationali colaboreaza cu autoritatile locale, in cazurile de interes comun, din punct de vedere juridic. Eu ma ocup in special de cazuri din Statele Unite care au legatura cu Romania. Iar Politia Romana imi solicita ajutorul in cazuri din Romania care au legatura cu SUA. Daca in Romania exista, de pilda, cazuri de coruptie care nu au legatura cu Statele Unite, noi nu avem posibilitatea de a ne oferi sprijinul.
In cateva cazuri, am oferit asistenta DNA-ului, pentru ca au existat unele legaturi cu Statele Unite. De asemenea, am desfasurat sesiuni de pregatire si le-am aratat politistilor si procurorilor romani cum anchetam cazurile de coruptie in SUA.

Do you think that is normal to have important resources dedicated for cyber-crimes while our police is having a hard time coping with the increased criminality ? There are situation when policemen have to pay themselves the gas for police cars and buy themselves equipment.
It is clear that FBI is focusing on the interests of US citizens and companies (which is normal) but I don't think it's fair to influence our police into dedicating important resources that should be used first of all in addressing real threats to our citizens.
2. Germany recently rejected a law that imposes phone/internet companies to keep detailed records of their clients activity. It was considered a violation of their citizens privacy. What's your oppinion on the issue ?

2. Este esential pentru autoritati sa aiba acces la datele companiilor de telefonie sau ale companiilor care isi desfasoara activitatea pe internet. Altfel, toti infractorii ar ramane anonimi si nu i-am putea prinde. La cele date, ar trebui sa aiba acces doar autoritatile si doar in scopuri justificate. Asadar este normal ca un procuror sa faca o solicitare de acest gen sau sa se deschida un caz penal. Personal, cred ca asemenea date ar trebui pastrate cel putin un an.

2. Cele mai comune infractiuni sunt fraudele de pe e-Bay, phishingul, si fraudarea cartilor de credit. Nu a existat nici un caz de terorism informatic in care romanii sa fi fost implicati.

Recently Mr Robert S. Mueller said that terrorist use the cyberspace as a "means to damage both our economy and our psyche", as recruitment or radicalization, using it to incite terrorism.
I would like to ask you what is the Bureau strategy in this domain.
I wonder if your approach in this domain is not flawed from the start. What defines a terrorist? Is he a radical, an extremist? That's it?
This is a very dangerous confusion the public opinion is making on this question. By being afraid NOT to take "a radical" stand on anything - because of the fear of not being identified by others as a "terrorist", the majority of the people are mixing all "good" and "bad" ideas (*almost on anything, from economy to ethics) in a blurry zone no one is sure what to say. And everything becomes "relative".
This type of confusion is exactly what all the terrorists and totalitarian regimes want, a mixed "truth" combined with a clever hidden message, witch serves their interests.
Because no one is SURE what to say. Because no one has the courage to say something absolute on anything.
Why do you not fight with their own weapons in this? Why not use the same "radicalization" and "extremism", in the same battleground and with the same method (teams of recruited individuals on forums, blogs etc) but on simply explaining all the ETHICS, the firm moral principles all democracies are based, the FIRM (extreme, radical) principles like "freedom of speech", the "non initiation of force against others", "Non Aggression", or all the "Natural Rights" a man has. Are they negotiable? Is it too "extreme" to say that a man has the right to live, to pursue his happiness or to defend his own life or property anytime? Does this absolute principle makes him a .."radical"?
Is the individualism too "extreme", is it a type or terrorism?

Discutand despre un caz ipotetic, sunteti la curent cu faptul ca autoritatile romane nu sunt in stare sa ofere programul de Wtness protection? In extenso, un cetatean roman, ce detine informatii concrete despre un astfel de grup ce desfasoara activitati ilegale pe teritoriul Romaniei si al USA nu poate decide sa inceapa o noua viata ajutand autoritatile de orinde ar fi ele pentru ca legea romana nu prevede protectie pentru astfel de persoane. Credeti ca s -ar implica FBI activ in protejarea unei persoane, poate o noua identitate in USA in schimbul oferirii de informatii ce ar putea duce la decaptiarea unei intregi retele internationale?
Conduc un site de comert electronic si saptamanal primim cateva comenzi despre care stim aproape sigur ca sunt tentative de frauda (aceste comenzi nu se onoreaza)
Problema este ca daca vreau fac o reclamatie pe cale oficiala pierd extrem de mult timp (am facut asta la inceput si am pierdut 2 zile facand reclamatii).
Ar fi mult mai eficient sa am la dispozitie o pagina in care sa pot furniza toate informatiile legate de tentativa de frauda: nume, IP, card, etc astfel incat sa pot raporta in timp utila (si economisind timp) TOATE tentativele de frauda.
Poate asa vom putea descuraja acest fenomen (daca nu stopa).
