Procurorul special Robert Mueller a anunțat miercuri că își dă demisia din Departamentul de Justiție, în prima sa declarație după finalizarea anchetei privind posibila ingerință a Rusiei în alegerile prezidențiale din 2016 s-a încheiat. Acesta a mai spus că inculparea președintelui Donald Trump ”nu a fost opțiune” legală, relatează AFP. Președintele Donald Trump a spus miercuri că declarația procurorului Robert Mueller nu a adus nimic noi despre el și este timpul să meargă mai departe. ”Cazul este închis”, a reacționat Trump pe Twitter.
UPDATE 19.51: Președintele Comisiei Judiciare din Camera Reprezentanților, Jerrold Nadler, a promis miercuri un răspuns al Congresului la ”infracțiunile, minciunile” lui Donadl Trump, la câteva minute după declarația lui Robert Mueller care a spus că inculparea unui președinte în exerciuțiu este neconstituțional.
UPDATE 19.15: ”Nu se schimbă nimic cu privire la raportul lui Mueller. Nu au fost probe suficiente și în acest caz, în țara noastră, o persoană este inocentă. Cazul este închis! Mulțumesc.”, a reacționat Trump pe Twitter.
Acesta a subliniat că în cazul în care Comisia de anchetă ar fi fost convinsă că preşedintele Donald Trump nu a comis nicio infracţiune, ar fi transmis clar acest lucru.
În prima sa apariție publice de la începerea anchetei în 2017, Mueller a spus că politica Departamentului de Justiție a împiedicat punerea sub acuzare a președintelui pentru o infracțiune, pe motiv că este în funcție.
”Un președinte nu poate fi pus sub acuzare pentru o infracșiune federală în timp ce este în funcție. Este neconstituțional”, a spus Mueller.
Procurorul special a mai spus că nu crede potrivită o mărturie a sa în Congres, în ciuda doreinței democraților de a-l audia.
Aceasta este prima sa declarație publică despre anchetă de la publicarea raportului său în aprilie. Mueller a concluzionat că nu a fost o conspirație între campania lui Trump și Moscova, dar a refuzat să ofere vreo concluzie cu privire la posibila obstrucționare a justiției de către președintele Donald Trump.
Carevasazica nu zice ca e nevinovat, ci ca nu oate fi pus sub acuzare. A detaliat multiple ocazii in care presedintele a obstructionat justitia, dar a lasat Congresul sa decida din cauza imunitatii.

4. The president called then called Don McGahn, the White House counsel at that time, and directed him to have Mueller removed because of asserted conflicts of interest.
5. He “dictated a message to be delivered to Attorney General Sessions that would have had the effect of limiting the Russia investigation to future election interference only.”
6. Actions by Trump and his personal counsel “could have had the potential to affect Flynn’s decision to cooperate, as well as the extent of that cooperation". “With respect to Manafort, there is evidence that the President’s actions had the potential to influence Manafort’s decision whether to cooperate with the government.”
7. “There is evidence that could support the inference that the President intended to discourage Cohen from cooperating with the government.
Mueller: "If we had confidence that the president clearly did not commit a crime, we would have said so."

"As set forth in our report, after that investigation, if we had confidence that the President clearly did not commit a crime, we would have said that.
We did not, however, make a determination as to whether the President did commit a crime. The introduction to volume two of our report explains that decision.
It explains that under long-standing Department policy, a President cannot be charged with a federal crime while he is in office. That is unconstitutional. Even if the charge is kept under seal and hidden from public view—that too is prohibited.
The Special Counsel’s Office is part of the Department of Justice and, by regulation, it was bound by that Department policy. Charging the President with a crime was therefore not an option we could consider.
The Department’s written opinion explaining the policy against charging a President makes several important points that further informed our handling of the obstruction investigation.
The opinion says that the Constitution requires a process other than the criminal justice system to formally accuse a sitting President of wrongdoing.
It would be unfair to potentially accuse somebody of a crime when there can be no court resolution of an actual charge.
